Trademark Registration
The procedure for registering a trademark in Taiwan involves the following steps:
- Search the Taiwan Intellectual Property Office (TIPO) database to ensure that the trademark is available for use and registration.
- Prepare and file a trademark application with the TIPO, including a description of the goods or services for which the trademark will be used and a representation of the trademark.
- Pay the application fee. The TIPO will review the application to ensure it meets the legal requirements for trademark registration. This process typically takes 4-6 months.
- If the application is approved, it will be published in the TIPO's Official Gazette, which gives other parties the opportunity to object to the registration.
- If there are no objections or if any objections are successfully resolved, the trademark registration will be granted and a certificate of registration will be issued. This process can take an additional 2-3 months.
- The trademark registration is valid for 10 years from the date of registration and may be renewed for successive 10-year terms.
It is important to note that the exact time frame for trademark registration in Taiwan can vary depending on various factors, such as the complexity of the trademark and the volume of trademark applications being processed by the TIPO. Additionally, there may be delays or additional steps required if objections are raised or if the trademark application is subject to a legal dispute.
